Description:

Exercising the right to be forgotten, in its various forms, poses many challenges for organizations called upon to handle such requests, particularly in terms of data protection. Although it is now codified at the provincial level and a jurisprudential trend is emerging at the federal level, its contours remain unclear in an environment where digital presence continues to grow. The situations in which it applies are varied: search results associated with a person's name, publication of articles dealing with sensitive aspects of their private life, or even the widespread dissemination of court decisions. This presentation aims to clarify the scope and limits of the right to be forgotten, while providing organizations with practical tools to respond effectively in the context of Canadian and Quebec law.
