Description:

For nearly ten years now, the case of Voltage Pictures LLC v. Salna et al. has been stuck in the elevator of the Canadian judicial system, stopping from time to time at the Federal Court, the Federal Court of Appeal, and the Supreme Court of Canada. Along the way, without having yet ruled on the merits of the case, the courts have ruled on several principles relevant to the protection of copyright against the piracy of cinematographic works on the Internet, including reverse class actions, Norwich orders, infringement by authorization, and the notice and notice regime provided for in the Copyright Act.

This presentation will analyze the impact of this saga following the recent decision of the Federal Court of Appeal in Voltage Pictures, LLC v. Salna, 2025 CAF 131 (an application for leave to appeal to the Supreme Court has obviously been filed since then).

The presenter, Me Lavoie Ste-Marie is a Director at Smart & Biggar, where he practices intellectual property litigation. He has particular expertise in extraordinary remedies in copyright law. In this capacity, he represents numerous major rights holders in the television, film, and music industries.
